Welcome to savesfbike.org. These Terms of Use ("Terms") are the rules for using the Save SF Bike website and for taking part in the programs and activities we offer through it. They explain what you can expect from us, what we expect from you, and how disagreements will be handled. We have tried to keep them readable, but they are a binding agreement, so please read them carefully.

These Terms work together with our Privacy Policy, which explains how we handle personal information, our Cookie Policy, and our Disclaimer. Questions can be sent to [email protected].

Acceptance of these Terms

By accessing or using savesfbike.org (the "site"), submitting a form, or signing up for a program or event we organize, you agree to these Terms. If you do not agree, please do not use the site or our forms.

In these Terms, "Save SF Bike," "we," "us," and "our" mean the Save SF Bike group and the volunteers who organize it. "You" means anyone who visits the site or takes part in our activities. If you use the site on behalf of an organization, you confirm that you are authorized to accept these Terms for it.

About us and non-affiliation with the SFBC

Save SF Bike is an independent, volunteer-run group of current and former members of the San Francisco Bicycle Coalition and other community members, based in San Francisco, California. We came together in 2015 to protect members' right to elect the SFBC Board of Directors, and we continue to advocate for transparent governance, ranked-choice voting in board elections, and safer streets for everyone.

Save SF Bike is not affiliated with, sponsored by, or endorsed by the San Francisco Bicycle Coalition. We do not speak for the SFBC, its board, or its staff, and nothing on this site should be read as an official SFBC statement. Signing up with us does not make you an SFBC member, renew your SFBC membership, or register you to vote in SFBC elections. To join or renew with the SFBC, please visit the SFBC directly. Any SFBC names or marks are used only to identify that organization accurately. See our Disclaimer for more.

We are a volunteer group, not a business. We do not charge for use of the site, and the site and programs are offered as a community service.

Eligibility

The site is intended for adults. You must be at least 18 years old (or the age of majority where you live) to submit our forms on your own behalf. The site is not directed to children under 13, and we do not knowingly collect information from them.

Young people are welcome in some of our activities, especially Learn-to-Ride. A parent or legal guardian must make all sign-ups for anyone under 18, accept these Terms on the minor's behalf, sign any required waiver, and remain responsible for supervising the minor as described in the program details.

Using the site

Subject to these Terms, we give you a personal, non-exclusive, non-transferable, revocable permission to view the site, read and share our content, download materials we make available for download (such as the Street Safety Audit Kit), and use our forms for their intended purposes.

You may share links to our pages freely, and you may quote reasonable portions of our articles for commentary, news reporting, research, or advocacy, as long as you credit Save SF Bike and link back to the original page. Please do not present our content as your own or edit it in a way that changes its meaning.

We may change, suspend, or discontinue any part of the site or any program at any time, for example because volunteers are unavailable, without notice and without liability to you. We do not promise the site will always be available or free of errors.

Acceptable conduct

We want the site and our programs to be welcoming, constructive, and safe. When you use the site, submit a form, or attend an event, you agree not to:

  • break any law or regulation, or encourage anyone else to do so;
  • submit false information, impersonate another person, or sign an endorsement in someone else's name;
  • harass, threaten, intimidate, or abuse any person, including volunteers, other participants, SFBC staff or board members, or members of the public;
  • post or send content that is defamatory, obscene, hateful, or discriminatory on the basis of race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, age, or similar characteristics;
  • send spam, chain letters, or commercial solicitations through our forms;
  • upload or transmit viruses, malware, or any code designed to damage or interfere with the site;
  • attempt to gain unauthorized access to the site, our hosting account, our email, or other users' information;
  • scrape, crawl, or harvest information from the site in a way that burdens it, or collect information about our supporters for any purpose other than reading our public supporter list;
  • use our content or supporter list to target, pressure, or retaliate against individuals; or
  • interfere with anyone else's use of the site or participation in a program.

We may ignore or delete any submission, decline or cancel any program registration, or block access to the site if we believe in good faith that someone has violated these Terms or is creating a safety risk.

Your submissions

When you send us a message, endorsement, comment, story, photo, or other material through our forms or by email (a "submission"), you keep any ownership rights you have in it. You confirm that the submission is your own, that it is accurate to the best of your knowledge, and that sharing it with us does not violate anyone else's rights.

Messages and stories

You give Save SF Bike a non-exclusive, royalty-free, worldwide permission to use, store, copy, and reply to your message for the purpose of responding to you and running our activities. We will not publish your name or the content of a private message without first asking you, except in anonymized and aggregated form (for example, "several members told us notice periods were too short").

If you send us a story, testimonial, or photo specifically for publication, you grant us a non-exclusive, royalty-free, worldwide license to publish, edit for length and clarity, and display it on our site, newsletter, and social media accounts, with credit as you request. You can ask us to take it down at any time and we will remove it from the places we control within a reasonable time.

Endorsements

When you endorse Save SF Bike, you allow us to count your endorsement in our supporter totals and to report anonymous statistics, such as how many endorsers are current or former SFBC members. If you chose "yes" to public listing, you also allow us to display your first and last name on our public supporter list. You may withdraw your endorsement or your consent to public listing at any time by emailing [email protected], as explained in our Privacy Policy.

Ideas and feedback

If you send us suggestions about our platform, programs, or the site, we may use them freely without any obligation to you. We appreciate them.

Personal information included in any submission is handled according to our Privacy Policy.

Intellectual property

Unless otherwise noted, the text, graphics, logo, layout, and other original content on the site are © Save SF Bike and its contributors. The name "Save SF Bike" and our logo identify our group; please do not use them in a way that suggests we endorse you, a product, or a candidate when we have not.

Photographs and other images on the site are credited to their respective owners or licensors and are used with permission or under the applicable license. Their copyright remains with those owners. Do not copy or reuse a photo from our site without checking its credit and the owner's terms. If you believe any material on the site infringes your copyright, please email us with the page address, a description of the work, and your contact details, and we will review it and remove the material promptly where appropriate.

Archived newsletters, documents, and public records we host for the historical record may contain material created by others, including the SFBC. Those materials remain the property of their authors and are provided for reference, commentary, and research.

Downloadable program materials, such as the Street Safety Audit Kit, may be printed and shared for non-commercial community use with attribution, unless the material says otherwise.

The site links to websites we do not control, including sfbike.org, SFMTA, Vision Zero SF, BART, Caltrain, the California Legislature's website, and social networks such as Facebook and X. Links are provided for convenience and reference; they do not mean we endorse the linked site or its content. We are not responsible for the accuracy, availability, or privacy practices of third-party sites, and your use of them is governed by their own terms. Our share buttons are plain links that open the social network only when you click them.

Program participation and assumption of risk

We organize hands-on, community activities, including Learn-to-Ride sessions, Neighborhood Listening Rides, Community Repair Clinics, and Street Safety Audits on public streets. These activities are led by volunteers, not professional instructors or licensed mechanics, unless a program description says otherwise.

Cycling and street activities involve real risks

Riding a bicycle, walking or standing near traffic, and working on bicycles carry inherent risks that cannot be fully eliminated, including falls, collisions with vehicles, other cyclists, pedestrians, or objects, road hazards such as potholes, rail tracks, and wet pavement, mechanical failure, weather, injuries from tools, and, in rare cases, serious injury or death. By choosing to participate, you acknowledge these risks and voluntarily assume them, to the fullest extent permitted by law.

Your responsibilities

  • Wear a properly fitted helmet on all rides. California law requires riders under 18 to wear a helmet, and we require helmets for all participants on our rides.
  • Follow all traffic laws, including the California Vehicle Code and local San Francisco rules, and obey traffic signals, signs, and the directions of ride leaders and police.
  • Make sure your bicycle is in safe working condition, with working brakes, inflated tires, and, for evening rides, front and rear lights as required by law.
  • Ride within your ability, tell the ride leader if you are uncomfortable with a route, and leave the activity at any time if you feel unsafe.
  • Tell the organizer in advance about any health condition or accessibility need relevant to your safe participation.
  • For Street Safety Audits, stay on sidewalks and in crosswalks, never step into traffic to take measurements or photos, and respect private property and residents.
  • At Repair Clinics, use tools only as shown, and understand that volunteer repair help is a learning exercise, not a professional service or a guarantee your bicycle is safe to ride. Have your bicycle checked by a professional shop if you are unsure.

Waivers and supervision

Some activities may require you to sign a separate participation agreement, release, or waiver before taking part. If so, that document will apply in addition to these Terms, and if they conflict on a matter covered by the waiver, the waiver controls. For participants under 18, a parent or guardian must sign. For Learn-to-Ride youth sessions, a parent or guardian must stay on site unless the program details state otherwise.

We may cancel or change any activity because of weather, air quality, safety concerns, or volunteer availability. We may ask anyone who is not following safety instructions to leave an activity.

No professional or legal advice

Content on the site, including our articles about SFBC bylaws, board elections, member voting rights, California nonprofit law, and traffic safety, is general information shared by volunteers to support public discussion. It is not legal advice, and it is not a substitute for advice from a qualified attorney, accountant, engineer, or other professional who knows the details of your situation. Reading the site or contacting us does not create an attorney-client relationship or any other professional relationship.

Board Candidate Coaching is peer support from people who have been involved in SFBC governance. It is not legal or campaign advice, and we do not guarantee any election outcome. For questions about your rights as an SFBC member, please consult the SFBC's current bylaws and, where appropriate, a qualified attorney.

Disclaimer of warranties

The site, its content, and our programs are provided "as is" and "as available," without warranties of any kind, whether express or implied. To the fullest extent permitted by law, Save SF Bike and its volunteers disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and accuracy. We do our best to keep information accurate and current, but we do not warrant that the site will be uninterrupted, secure, or error-free; that any content is complete or up to date; that defects will be corrected; or that the site or our server is free of viruses or other harmful components. Some content is kept for the historical record and may no longer reflect current conditions, as explained in our Disclaimer.

Limitation of liability

To the fullest extent permitted by law, Save SF Bike, its organizers, volunteers, and contributors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, goodwill, or opportunity, arising out of or related to your use of, or inability to use, the site, its content, or our programs, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability for any claim arising out of or related to these Terms, the site, or our programs is limited to one hundred US dollars (US $100). Because we provide the site and programs free of charge as a community service, you agree that this limitation is reasonable.

Nothing in these Terms limits liability that cannot be limited under applicable law, such as liability for gross negligence, willful misconduct, or fraud. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Save SF Bike and its organizers and volunteers from any claims, damages, losses, liabilities, and reasonable costs (including reasonable attorneys' fees) arising out of: your violation of these Terms; your submissions, including any claim that a submission infringes someone else's rights or is defamatory; your violation of any law or the rights of any third party; or your conduct during any program or activity. We will notify you of any such claim and may choose to participate in the defense with counsel of our choosing.

Governing law and venue

These Terms and any dispute arising out of or related to them, the site, or our programs are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules. You agree that any legal action or proceeding will be brought exclusively in the state or federal courts located in the City and County of San Francisco, California, and you consent to the personal jurisdiction of those courts.

Before filing any claim, we ask that you first contact us at [email protected] and give us at least 30 days to try to resolve the issue informally. Most concerns can be settled with a conversation.

Changes to these Terms

We may revise these Terms from time to time, for example to reflect new programs or changes in the law. When we do, we will update the "Last updated" date at the top of this page. Significant changes will also be announced on the home page. Changes take effect when posted and apply to your use of the site after that date; they do not apply to disputes that arose before the change. If you continue to use the site after changes are posted, you accept the revised Terms.

Severability and waiver

If any part of these Terms is found to be invalid or unenforceable, that part will be enforced to the maximum extent permitted and the remaining parts will stay in full effect. Our failure to enforce any provision is not a waiver of our right to enforce it later. You may not transfer your rights under these Terms to anyone else; we may transfer ours to a successor organization that agrees to be bound by them.

Entire agreement

These Terms, together with our Privacy Policy, Cookie Policy, Disclaimer, and any program-specific waiver or participation agreement you sign, are the entire agreement between you and Save SF Bike about the site and our programs. They replace any earlier understandings on the same subject. Section headings are for convenience only and do not affect interpretation.
